PERMIT #: M- 1985 -184 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: March 20, 2014 <br />OBSERVATIONS <br />This was a routine monitoring inspection conducted by Eric Scott and Amy Eschberger of DRMS for the Bivens Pit site. DRMS met <br />with Aaron Bivens (site owner / operator) of Bivins Trucking and Excavating on site. The site entrance is located off the north side of <br />Willox Lane approximately 1/2 mile west of Hwy 287 ( North College Ave) just north of Fort Collins, CO and is marked with a large <br />sign. The required site entrance postings were present. <br />The site is currently being used as a construction material recycling facility, with little if any mining taking place. The owner /operator <br />stated that he does not currently have any plans to begin mining again at this time, but wishes to retain the permit in case he wants to <br />enlarge the existing lake and sell the material. Some concurrent reclamation activity at the site is still on- going. The recycling facility <br />and the supporting facilities and structures appear well run and maintained, and an affidavit for importation of material is on file with <br />DRMS. All issues noted during the previous inspection, such as tamarisk trees, Russian olive trees, and sloping of the majority of the <br />existing shoreline have been well addressed. There is a small portion of the NE corner of the pond that still requires re- sloping to 3:1 <br />slopes and re- vegetation, but overall the site was in good condition. <br />Bond for the site is currently $40,000. This would appear to be adequate at this time if the remainder of the shoreline of the existing <br />pond is re- sloped properly to 3:1 or less. <br />DRMS discussed the site further with the operator after the site tour and recommended that they strongly consider if additional mining <br />would be taking place in the future, or if it would be more prudent to file an amendment to change the post mining land use to <br />commercial, release the mining permit, and recover the bond. If additional material is not excavated from the site and sold, a mining <br />permit is not required. <br />DRMS also reminded the operator to be mindful of the permit boundary to avoid out -of- bounds violations, especially along the west <br />side of the property where the permit boundary and property boundary are no longer the same.
