There is a portion <br />of the permit boundary that is on Union Pacific Railroad's (UP) right of way. <br />UP will grant the Applicant right of entry on UP's property to construct the rail <br />spur. <br />The UP right of way within the permit boundary begins at MP 463.97 on UP's <br />southern right of way, extends northerly approximately 100 feet to the <br />centerline of the rail at MP 463.97, follows the centerline of rail westerly to <br />MP464.41, then southerly approximately 100 feet to the UP's southern right <br />of way line at MP 464.41 then easterly along UP's southern right of way to <br />the point of beginning containing 5.3 acres more or less. <br />The Applicant has a thirty foot wide easement for Haul Road #1 that <br />extends from 15 Road to the eastern edge of CAM's property. The <br />easement crosses property owned by Fruita Development, LLC. <br />The proposed permit boundary is located in: <br />Township 1 North, Range 3 West, Ute P.M. <br />Section 2: Portions of the SW /4, W /2SW /4SE /4 <br />Section 3: Portions of the SE /4, SE /4SE /4NE /4 <br />Section 10: Portions of the N /2NE /4 <br />Section 11: Portions of the N /2NW /4, N /2NE /4, SE /4NE /4 <br />The proposed Fruita Loadout permit boundary contains 208.6 acres of land <br />that is all located on private surface. CAM - Colorado, LLC owns 201.3 acres, <br />the Union Pacific Railroad owns 5.3 acres, Fruita Development LLC owns 2.0 <br />acres.
