Puieda <br />Director <br />The Division has reviewed the packet containing the proof of notices you sent; the packet was received <br />here on March 11, 2014. It contained the proof of publishing a notice in the newspaper, and proofs that <br />the mailed notices were sent to and received by all adjoining landowners. <br />The affidavit of the published notice contained a newspaper clipping of the notice, and all information in <br />it appears correct. <br />The other notices in the packet, i.e., the ones that were mailed to all adjoining landowners, however, <br />contained a small error in the content. The error is the omission of the date of the close of the public <br />comment period. The certified receipts indicate you mailed these notices in a timely fashion to all of the <br />adjoining landowners, and all of them received the notice. To -date, the Division has received no adverse <br />comment or objection from any of the parties. The Division does not feel that this error of omission will <br />require you to re -mail corrected notices to all landowners, but the Division feels it is appropriate to keep <br />the comment period open until the date of the Division's decision on the application. <br />As you know, the decision date was extended until April 14, 2014. <br />I look forward to receiving the adequacy response materials you are preparing. Please ensure that you <br />send two sets of all written materials directly to the Division's Denver office (address in letterhead, <br />above).
