The New Horizon North Mine operated under Colorado <br />Division of Reclamation, Mining and Safety (CDRMS) Permit No. C- 2010 -089. <br />Western Fuels has made the following corrections /modifications in response to the Division's <br />preliminary adequacy review letters, dated December 5, 20I3 and January 7, 2014. <br />1. The reference to Appendix 2.05.6(3) -4 on page 4 of Section 2.05.6(3) has been retained <br />and Appendix 2.05.6(3) -4c Approved Well Permits Groundwater Monitoring Wells has <br />been added. <br />2. All references proposed as part of TR -05 in the revised permit text that refer to GW -N56, <br />GW -N57 and GW -N58 as the points of compliance for the NHN Mine permit have been <br />removed. <br />The sentence on page 5 in Section 2.05.3(3) which states, "The minimum safety factor for <br />all embankments will be 1.25" has been retained. <br />4. Due to restrictions from the APCD Construction Permit, plans are being made to remove <br />the perimeter haul roads, and replace them with haul roads located within the interior of the <br />permit.
