filed by the owner. The property surrounding the proposed <br />telecommunication site is zoned as Industrial. The subject property is <br />presently zoned for industrial use. <br />3. The Special Use Review permit application proposes a use consistent with the <br />relevant provisions of the Costilla County Comprehensive Plan, the Costilla <br />County Land Use Code. The proposed development within this zone district <br />is permitted only upon Special Use Review. <br />4. The applicant proposes the construction of a telecommunication tower <br />approximately 180 feet in height which shall be located no closer than 750 <br />feet from other transmission towers. Additionally, the applicant proposes the <br />construction of an equipment building of approximately 300 square feet <br />adjacent to the tower. The Special Use Permit application is limited to the <br />2500 square feet upon which the tower and accessory building will be located. <br />There is a public and /or county road that provides public access to the facility. <br />All utilities to the site will be installed underground as is required by the <br />County Land Use Code. <br />5. The applicant proposes to allow future telecommunication service providers to <br />co- locate on the tower if its application is granted. Furthermore, the applicant <br />acknowledges the requirements of the Federal Telecommunication Act of <br />1996 and any additional requirements imposed by the Federal Aviation Act. <br />The Land Use Administrator and the Planning Commission recommend the <br />approval of the Special Use Permit application on their findings that the <br />application and proposed development comply with the General Approval <br />Standards applicable to telecommunication facilities and the Limited impact <br />and/or Special Use Review Standards set forth in the Costilla County Land <br />Use Code. The Planning Commission and /or the County Land Use <br />Administrator condition their recommendation for approval on compliance <br />with the following requirements: <br />a. That the facility be constructed with the use of non - reflective material. <br />b. All electrical utilities be installed underground from the existing <br />main electrical line to the electrical utility building. <br />c. All disturbed soils will be reclaimed and re- vegetated to its natural pre - <br />construction condition. <br />d. The telecommunication tower will be sited at the center of the leased <br />parcel so that the tower's location is in compliance with the setback <br />requirements of the Land Use Code <br />
