Pineda <br />Director <br />The Colorado Division of Reclamation, Mining, and Safety ( CDRMS) have found the above referenced <br />report to be in compliance with CDRMS Regulations: 4.09.1(11) and 4.10.2(2), unless noted below. <br />The above referenced report was prepared by North West Colorado Consultants (NWCC) for <br />Twentymile Coal Company. NWCC visited the site on October 18th and December 31st, 2013. Based <br />on the report, NWCC did not observe any signs of instability, structural weakness or hazardous <br />conditions at the pile. These observations reflect observations with on -site inspections conducted by the <br />Division of the Waste Pile. The report states that the wash plants produced approximately 402,491tons <br />of waste coal. <br />On June 10th a total of six compaction tests were conducted at the Expansion Area. All tests met the <br />minimum compaction requirement of 90% of the maximum standard Procter density. <br />Please note, per Rule 4.09. 1 (1 1)(c) any certified report addressing the underdrain system and protective <br />filters shall include color photographs taken during and after construction, but before underdrains are <br />covered with excess spoil (or refuse). No photographs were included with the inspection and the <br />Division has noted in normal Inspection and Enforcement Inspection of the site, the ongoing <br />construction of the underdrain. Please provide photographs per Rule 4.09.1(11)(c) of on going <br />construction of the RDA underdrain. <br />If you have any questions feel free to contact me.
