Box 246 <br />Dove Creek, CO 81324 <br />RE: Reason to Believe a Violation Exists, Rescheduling of Board Hearing, <br />H & H Stone Quarry #2, Permit No. M- 1998 -080. <br />Dear Ms. Holley: <br />COLORADO <br />D I V IS I ON OF <br />RECLAMATION <br />MINING <br />SAFETY <br />John W. Pineda <br />Director <br />On July 16, 2013 The Division of Reclamation, Mining, and Safety (Division) notified you that <br />your financial warranty letter of credit for permit M- 1998 -080 in the amount of $6,347.00 was <br />unable to be verified. You were advised that H & H Stone had sixty (60) days to verify that the <br />existing letter of credit was still valid or submit a replacement warranty in the same amount. H <br />& H Stone has failed to comply with the above requirements. <br />Therefore, the Division believes this is in violation of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, C.R.S. 34- 32.5 -101 et. seg., and specifically C.R.S. <br />34- 32.5 -117 (6) for failure to maintain a financial warranty in good standing for the life of the <br />permit. Therefore, the Division has found reason to believe violations exist to the Law and has <br />scheduled this matter before the Mined Land Reclamation Board (Board). <br />You have requested a continuance of the matter set for February 19, 2014 to gain compliance. <br />The Division is willing to continue the issue to the March Board hearing only to gain voluntary <br />compliance. If H & H Stone fails to submit acceptable replacement financial warranty <br />documents by March 21, 2014 the Division will proceed with enforcement action. Please note <br />the notice of the March hearing below which will only be withdrawn with full compliance by <br />March 21St, 2014. <br />A Formal Board Hearing will be held during the March 26 & 27, 2014 Board meeting for <br />consideration of the possible violations. The hearing will occur at 1313 Sherman Street, Room <br />318, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be <br />considered. At the hearing you will have opportunity to be represented and heard.
