Owner: <br />Cindy Smith, CDPHE <br />David Foster, CDPHE <br />Complaint <br />SW/FRE/FPR 1.6 <br />-- BACKGROUND— <br />Mr. John Paul Ary <br />Fremont Paving & Redi -Mix, Inc. <br />839 Mackenzie Avenue <br />Canon City, Colorado 81212 <br />phone: (719) 275 -3264 <br />The purpose of the inspection was to assess the facility's compliance status with respect to the Solid Wastes <br />Disposal Sites and Facilities Act, CRS 30 -20 -100.5 et. Seq. (the Act), and the Regulations Pertaining to Solid <br />Waste Sites and Facilities, 6 CCR 1007 -2 (the Regulations). Note: this report presents findings relative to the <br />solid waste regulatory program; hazardous waste findings are presented in a separate inspection report. <br />- -SITE INSPECTION -- <br />On the afternoon of January 22, 2014, CDPHE inspectors Cindy Smith and David Foster of the Colorado <br />Department of Public Health and Environment (CDPHE), Hazardous Materials and Waste Management <br />Division, arrived onsite to inspect the facility subsequent to receiving an anonymous complaint that tires, oil, <br />televisions and electronics are being buried onsite, and then covered with top soil and concrete washout. <br />These activities were allegedly occurring adjacent to the onsite fabrication shop and a water canal used by <br />farmers. Initially inspectors met with John Paul Ary (owner, Fremont Paving & Redi -Mix), Denise <br />Gonzalez (office manager, Fremont Paving & Redi -Mix) and Jordan Sasser (environmental coordinator, <br />Fremont Paving & Redi -Mix). Inspector Foster shared the nature of the complaint. Mr. John Paul Ary stated <br />that he did not have knowledge of any waste burial activities occurring onsite. <br />Mr. Ary stated that the company began in 1981, and that they currently employ approximately 100 people. <br />The company generates used oil from vehicle maintenance activities, and pays to have used oil transported <br />offsite by Thermofluids for recycling. The facility utilizes two parts washers that are serviced by Safety <br />Kleen, and vehicle batteries are picked up by Carquest. The batch plant is run on natural gas. <br />Mr. Ary and Ms. Sasser agreed to escort CDPHE inspectors onsite. The group initially proceeded to the <br />concrete washout area located in the southwest corner of the property. See Photos 1 -11. Inspectors Smith <br />and Foster previously observed this area while waiting for facility representatives to return to the site from <br />lunch. Mr. Ary stated that the same concrete washout area has been used for thirty years, since 1980. <br />Inspector Smith inquired whether the concrete washout basins periodically have to be mucked out. Mr. Ary <br />explained that the basins are scraped out approximately every five years and the excavated sedimentation is <br />hauled back over to the recycle concrete pile where it can be used for road base or injected back into <br />concrete batch mixes. <br />
