Mine staff on the inspection included Ross Gubka <br />and Frank Ferris. Weather conditions were clear and warm. There was no activity at the New Horizon Mine <br />during this inspection. The primary area inspected was Pond 13 and the drainage area above this pond. <br />HYDROLOGIC BALANCE - Rule 4.05 C Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The area above Pond 13 was inspected because Western Fuels plans to submit a proposal for a trench <br />drain to divert spoil spring water away from the prime farmland area. Water is ponded directly above Pond 13 and <br />in low areas with small excavated ditches. In other areas the soil is relatively dry. Several photographs were <br />taken of the area for use in reviewing the design submittal. <br />The only pond inspected was Pond 13. It was discharging clear water to Tuttle Draw at approximately 0.24 cfs. <br />Per Ross Gubka, this is mostly spring water. No problems were identified with the structures of the pond <br />(spillways, embankment, flume). In Tuttle Draw, near the pond discharge, rust coloring is seen in the channel. <br />The Division will review records to determine if there has been a significant change in water quality in Tuttle <br />Draw since Pond 13 began discharging. <br />The NH2 Pit was holding a large amount of water. Per Mr. Gubka the depth is approximately 13 feet. The <br />surface area was approximately three to four acres (a rough estimate using only visual observation). The Division <br />will work with Western Fuels to ensure that the holding capacity of Pond 13 is sufficient when the pit is pumped <br />into the pond (there needs to be enough for the 10 -year, 24 -hour storm). <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 2 of 5 <br />
