Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, P.E. <br />Director /State Engineer <br />V E D <br />MAR 10 2014 <br />Division of r;,,;,;1amation, <br />Mining & Safety <br />We have received your letter of December 30, 2013, requesting renewal of the above - referenced <br />substitute water supply plan to cover depletions caused by an existing gravel mining operation operated by <br />Northern Colorado Constructors, Inc. ( "NCCI" or "Applicant "). The required fee of $257.00 for the renewal <br />of this substitute supply plan ( "SWSP ") has been submitted (receipt no. 3663118). The original supply <br />plan was approved on December 30, 2002 and the SWSP was most recently renewed on December 31, <br />2013. <br />Plan Operation <br />This plan seeks to replace depletions resulting from mining at the NCCI Pit #1. In 2014, the <br />mining operation will encompass multiple ponds and ditches as depicted in Figure 2, including process <br />ponds, a sedimentation pond, dewatering ditches, and recharge ditches. The total exposed water <br />surface of these features at the site will be 8.48 acres. <br />During the period of this SWSP, depletions at the site will result from evaporation, water lost in <br />mined product, and dust control. The Applicant does not anticipate using any water for the production of <br />concrete and asphalt during the requested plan period. The lagged depletions will be replaced using <br />fully consumable effluent leased from the City of Thornton ( "Thornton "). <br />In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of <br />Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining operators must comply with the <br />requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection <br />of water resources. The April 30, 2010 letter from DRMS requires that you provide information to <br />DRMS to demonstrate you can replace long term injurious stream depletions that result from mining <br />related exposure of ground water. The DRMS letter identifies four approaches to satisfy this <br />requirement.
