HINER 719 336 -3467 STATE OF COLORADO Division of Reclamation, Mining & Safety Department of Natural Resources 1313 Sherman Street Room 215 Denver Colorado 80203 Gentlemen: March 2, 2014 RECEIVED 2014 DIVISION OF';ECLAMATION MINING AND SAFETY RE: Permit M- 1977 -151 Operation- Name:Gsreeley Pit Anniversary Date: 1/30/2014 On January 28, 2014 I sent my Annual Mined Land Reclamation Report and Fee for Permit M- 1977 -151, the Greeley Pit located in Weld County Colorado at 2220 '0' Street, Greeley. We were going over our mining papers and found the letter from Peter S. Hays, Environmental Protection Specialist II, dated December 3, 2013 which spelled out the lakes and the measurements and the pre -law disturbances as per his inspection of the Greeley Pit on November 15, 2013 as part of the Division's monitoring inspection program. In my January 28, 2014 letter addressed to you Gentlemen, I gave some inaccurate information and this letter is to CORRECT those oversights. I have enclosed a copy of Mr Hays letter and hi- lighted his paragraphs I am referring to in pink and I also have enclosed a copy of my letter with the inaccurate information hi- lighted in orange. CORRECTION: On the 112c Annual Report, Question 7 - the number of acres affected should read - the 5.7 acre lake, the 21.2 acre lake and the 13.3 acres of the 40 acre lake are considered pre -law disturbances and does not require the operator to replace the evaporative depletions for the exposed groundwater in these lakes. Only 26.7 acres of the 40 acre lake and now the 5.4 acre lake totaling 32.1 acres is what Question 7 should be covering. Please accept my apology for my error in my January 28, 2014 reporting.
