L PROCEDURES AND SUMMARY OF THE REVIEW PROCESS
<br />Seneca Coal Company, LLC applied for a partial bond release under the Colorado Surface Coal
<br />Mining and Reclamation Act following reclamation of the Yoast Mine. The mine area is located
<br />in:

<br />The Division has previously approved four bond release applications at the Yoast Mine. SL -1,
<br />approved on March 6, 2007, released $11,862.00 of Phase I liability on 173.02 acres in the North
<br />Pit. SL -2, approved June 15, 2010, released $790,205.00 of Phase I liability on 456.7 acres in
<br />the South Pit and Neck Pit areas. SL -3, approved on January 18, 2012, released $1,693,918.00
<br />of Phase II liability on 592 acres in the North and South Pit areas. SL -4, approved November 9, 2012,
<br />released $452,336.00 Phase I liability of 115.5 acres, consisting of the Yoast Access road, light use
<br />road LU -1, Pond 010, light use road LU -2, topsoil stockpile I, the dragline assembly /disassembly
<br />pad, the YPM -8 drainage channel, YPM -8 watershed, light use roads LU -3A and LU -313, and Stock
<br />tank ST -1. No Phase III bond release has previously been granted on any of the disturbance area.
<br />Table 1 of this document provides a detailed summary of previous bond release acreages and
<br />exclusions. The Division did not approve Phase I bond release of the dragline deadhead route with
<br />approval of SL -4 due to round -about construction by Routt County at the time of SL -4 review.
<br />An application for partial Phase I, 11 and III (final) bond release was received by the Division on August
<br />26, 2013. The application was deemed complete on December 3, 2013, after the Division received proof
<br />of publication of the applicant's public notice. Seneca Coal Company, LLC published notice of the bond
<br />release application in Steamboat Pilot once weekly for four consecutive weeks, beginning September 29,
<br />2013. Seneca Coal Company, LLC also notified land owners within and adjacent to the mine permit
<br />area, and other interested parties of the application for bond release, as required by Rule 3.03.2(1).
<br />No comments, written objections, or requests for an informal conference regarding the bond release
<br />application were received by the Division.
