PUBLIC NOTICE
<br />Peabody Sage Creek Mining, LLC, 36633 Routt County Road 27, PO Box 250, Hayden, CO
<br />81639, has filed with the Colorado Division of Reclamation, Mining, and Safety (DRMS), an
<br />application for Permit Revision (No. 1) to the Sage Creek Mine, Permit C -09 -087. This permit
<br />revision is for the extension of continuous mining sections and expansion to longwall mining,
<br />including an increase in the mining permit boundary area.
<br />The mine permit area, encompassing approximately 10,546 acres, is located approximately nine
<br />miles south of the Town of Hayden, Colorado, off Routt County Road 27. The general legal
<br />description for lands affected by the Mine Permit Application Package (PAP) are located in
<br />Township 5 North, Range 87 West, all or portions of Sections 1, 2, 3, 4, 5, 8, 9, 10, 11, 12, 13,
<br />14, 15, 16, 21, 22 and 23; and Township 6 North, Range 87 West, all or portions of Sections 27,
<br />28, 29, 32, 33, 34, 35, and 36.
<br />The permit term is for five (5) years. Affects comprise only a small portion of the entire permit
<br />area. Surface and coal ownership within the proposed permit area include Sage Creek Holdings,
<br />LLC; the State of Colorado; and the U.S. Department of Interior (Bureau of Land Management).
<br />The ownership, precise location, and boundaries of lands within the permit area are identified in
<br />Section 2.03, and on Map 2.03 -M1, of the PAP, and are included in this public notice by
<br />reference.
<br />Copies of the PAP, including the referenced Permit Revision application, are available for
<br />inspection at the mine office and the office of the Colorado Division of Reclamation, Mining,
<br />and Safety. A copy of the Permit Revision application is also available for public inspection on
<br />line at via the Division of Reclamation Mining and Safety website.

<br />Written comments or objections to the Permit Revision application should be submitted to the
<br />State of Colorado Division of Reclamation, Mining, and Safety, 1313 Sherman Street, Room
<br />215, Denver, Colorado 80203 -2273 within ten days of the last date of publication of this notice.
