February 25, 2014 C- 2010- 089/New Horizon North Mine MPB <br />The burrowing owl mitigation plan was recently implemented at an area to be mined north of the current disturbed <br />area. This location is on WFC property south of Meehan Draw. The mitigation plan consists of backfilling <br />prairies dog holes, which the owls may use to burrow. Numerous prairie dog holes were backfilled and marked <br />with flagging (Photograph No. 4). Meehan draw was viewed. There are numerous cattails present in the bottom <br />of the draw and there was a small trickle of water flowing at the time of the inspection (Photo No. 5). <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Sedimentation Pond NHN -001 was inspected. The pond is containing a small amount of water at the east end of <br />the pond. Photograph No.6 shows the west end of this large sedimentation pond. The pond appears to be well <br />constructed with no problems noted. The emergency spillway and primary spillway are stable and functional. <br />Pond inlets and embankments were stable. <br />The active pit area was inspected. This the second cut north of the original boxcut. We drove to the base of the pit <br />and viewed the exposed coal seams. There is only a very small amount of groundwater seeping from the lower <br />end of the highwall and from the pit bottom on the north pit wall (see Photo No. 7). <br />SUPPORT FACILITIES - Rule 4.04: <br />The facilities area constructed in the southeast corner of the permit area was viewed. At the time of the last <br />inspection a new secondary containment for the diesel fuel storage tank was being constructed. The secondary <br />containment has been completed and it consists of concrete walled structure with a heavy -duty liner (Photograph <br />No. 8).
