PERMIT #: M- 1990 -116 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: February 25, 2014 <br />OBSERVATIONS <br />This was a pre- operation inspection conducted by Eric Scott of DRMS for the pending 110c to 112c permit <br />conversion for the existing Kennedy Pit permitted and operated by Phillips County. DRMS followed Phillips <br />County Planner, Randy Schafer to the site for the inspection. This site is a stream channel excavation taking <br />place in a segment of Frenchman Creek north of and adjacent to County Road 18 between County Roads 53 <br />and 55. <br />As can be seen in the attached photos, mining has moved from west to east within the permit, and the west <br />end of the creek channel is now partly re- sloped and reclaimed, while the east end is still being mined. The <br />south bank of the creek is currently very close to County Road 18. Because this is also the cut -bank side of the <br />creek at this location, the county may want to consider submitting an affidavit for inert fill (in accordance with <br />Rule 3.1.5(9)) to be used at the site, so that the area could be reinforced with the concrete present on site to <br />prevent excessive erosion. <br />As stated on the first page of this report, one issue was noted during the pre -op inspection that will need to be <br />resolved by the permittee within 30 days and /or prior to beginning new mining activity at the site. The new <br />permit boundary will need to be clearly marked. The permittee will need to submit photos of the markers, <br />and GPS location data of permit corners to the Division to show that this issue has been resolved by March 27, <br />2014 as stated on the first page of this inspection report. <br />Inspection Contact Address <br />Randy Schafer <br />Phillips County <br />221 S.
