The only new information we can add at this time arc in
reference to the addendum you provided by Geotechnical Consulting dated May 1999. This addendun7 states they have acquired
permits for 150-acre feet of nontribumry water. it will be necessary for the applicant to properly identify ths permit numbers of their
sources for water supply. Please reference our previous letter concerning the one valid permit number 49219F for 93.0 acre feet.
Also referenced is an alternative water supply of 150-acre feet from the City of Pueblo. Rio Grande will need to provide a letter of
commitment from them if this source is used.
The quarry plan submitted references dust suppression. Our concern is the use of the water collected in the erosion impoundments.
Water in these impoundments is subject to the priority system and not available to use unless it was obtained in priority. Our Denver
Office will review the overall plan after they apply for their mining permit.
The applicant will need to have approved well permits for the proposed sites and should submit a proposed water needs plats along
with their mining permit. We carmot speculate as to whether such well permits will be granted. We rec9mmend the above items be
clarified before approval is granted. Please forward these comments to the applicant and Mr,Hipwel1.
Sincerely,
Jai t Kuzmial;,
Well Commissioner,Division 2
CC:Joe Flory,Water Commissioner District 14 and 15
Steve Witte,Division Engineer
Dick Wolfe,State Engineer's Office
EXHIBIT
