8. Wildcat acknowledges that it is currently subject to a cease and desist
order and will not conduct any mining, milling, or reclamation related operations or
activities at the site other than those activities approved by the Division in writing
necessary to bring the permit into compliance and to prevent damage to offsite
areas and to protect human health and safety.
9. Wildcat agrees that failure to comply with all requirements and
timeframes specified in this joint stipulation constitutes continued failure to comply
with a Board Order and is grounds for an immediate hearing for final permit
revocation and forfeiture of the financial warranty.
10. This matter will be noticed on all Board agendas starting in March
2014 as an Enforcement Hearing to consider forfeiture of Wildcat's financial
warranty. No additional notice will be required as Wildcat is on notice that failure
to comply with any outstanding Board ordered corrective action or deadline
constitutes grounds for final permit revocation and financial warranty forfeiture. In
the event Wildcat remains in compliance as of the date of the regularly scheduled
Board meeting the Division will not seek forfeiture but will instead provide a status
update to the Board.
tot:' 5
DONE AND ORDERED this day of February 2014.
FOR THE COLORADO MINED LAND
RECLAMATION BOARD
Barbara Green, Chaim
