9. Wildcat agrees that failure to comply with all requirements and timeframes
specified in this joint stipulation constitutes continued failure to comply with a Board Order
and is grounds for an immediate hearing for final permit revocation and forfeiture of the
financial warranty.
10. This matter will be noticed on all Board agendas starting in March 2014 as
an Enforcement Hearing to consider forfeiture of Wildcat's financial warranty. No
additional notice will be required as Wildcat is on notice that failure to comply with any
outstanding Board ordered corrective action or deadline constitutes grounds for final permit
revocation and financial warranty forfeiture. In the event Wildcat remains in compliance
as of the date of the regularly scheduled Board meeting the Division will not seek forfeiture
but will instead provide a status update to the Board.
WHEREFORE, the parties respectfully request that the Board approve this joint
stipulation at its February 19, 2014 meeting.
Respectfully Submitted this 7th Day of February, 2014.
11, Fugate../
Assistant Attorney General
Attorney for the Division of Reclamation,
Mining and Safety
nn
TRAURIG, LLP
Attorney for Wildcat Mining Corporation
