He is expected to testify with respect to his <br />site investigation of the Morgan property, his evaluation of soils, and the suitability of subsoil <br />replacement, as generally described in his correspondence of November 16, 2010. <br />Dean Stindt, <br />2465 South Townsend Ave. <br />Montrose, Colorado 81401 <br />(970) 321 -4261. <br />Mr. Stindt was previously employed by NRCS and did the initial visit to the pre -mine site <br />in 1992. Mr. Stindt's is expected to testify with respect to the identification of Barx soils on the <br />east side of the Western Fuels mine site. <br />David Berry <br />Colorado Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />(303) 866 -3567 <br />Mr. Berry is the Director of DRMS. He may be called to testify with respect to the <br />permitting history of the New Horizon Mine, DRMS oversight of the mine, permit revisions, and <br />applicable regulations.
