The Mined Land Reclamation Board is hereby directed to assemble and transmit to the
Court and the parties in CD Rom format certified copies of the following records and materials
pertaining to Permit Number C1981 -008, Permit Revision No. PR -06, as follows:
a. all PR -06 permit submittals by the Applicant;
b. all DRMS review documents, memoranda, and correspondence received or
generated in the review of PR -06;
C. all DRMS decisions, documents, and memoranda provided to the Board;
d. all review comments, objections, letters of support, or similar records pertaining
to PR -06 submitted by Objectors, the Applicant, and other persons;
e. the transcript of the November 17, 2010 Board hearing and the October 29, 2010
pre- hearing conference;
f. all motions or other pleadings filed in advance of November 17, 2010 Board
hearing;
g. all memoranda, briefs, the Proposed Decision, and all exhibits (both admitted and
excluded) that were offered to the Board by the Applicant, Objectors, and DRMS
in connection with PR -06 on November 17, 2010;
h. all orders and decisions pertaining to PR -06 issued by the Board including: Order
of November 29, 2010 -- Special Hearing of Board to consider Plaintiff's
objection letters; motions setting formal hearing on PR -06; Board Order of
November 8, 2010— pertaining to request for Skype appearance and/or extension;
Board Order of December 8, 2010— hearing held on November 17, 2010;
Proposed Hearing Order of November 4, 2010; Conference Officer Order of
November 8, 2010.
i. November 1, 2010 subpoena issued to Jim Irvine;
all communications received by DRMS from federal Office of Surface Mining
( "OSM ") and pertaining to OSM oversight of PR -06.
The Board is directed to assemble these documents and Plaintiffs shall promptly pay the
reasonable costs of doing so. The parties shall then implement the briefing schedule previously
agreed to and adopted as an order.
