beneath the easternmost portion of the Morgan property is supported by substantial <br />evidence in the form of the Walsh report. The overall prediction of reclamation <br />success is supported by technical documents and data of the sort the Board is <br />uniquely qualified to evaluate when it renders the kind of complex, technical <br />judgments at issue in PR -6. This is exactly the type of judgment delegated to <br />regulatory agencies and is not normally within the province of the courts. The <br />topsoil depths the Board approved are comparable to the pre- mining topsoil depths. <br />The irrigation plan and post -mine topography were also correctly approved, as <br />requested by the plaintiffs themselves. <br />STANDARD OF REVIEW <br />The standard for judicial review for an MLRB decision under the Colorado <br />Coal Program is set forth in C.R.S. § 34 -33- 128(2), which provides "[t]he findings <br />of the board, if supported by substantial evidence on the record considered as a <br />whole, shall be conclusive." Substantial evidence is "more than a scintilla, and <br />must do more than create a suspicion of the existence of the fact to be established. <br />It means such relevant evidence as a reasonable mind might accept as adequate to <br />support a conclusion." Integrated Network Services, Inc. v. P. U. C., 875 P.2d 1373, <br />1378 (Colo. 1994), quoting NLRB v. Columbian Enameling & Stamping Co., 306 <br />U.S. 292, 300 (1939).
