use of side rolls and was designed by Jim Boyd at NCRS at the request of the
Morgan family. R. 6319, first paragraph. Mr. Boyd stated that "[t]his proposed
irrigation design provides the most efficient and flexible system for the conditions
presented .... With proper management, this irrigation system will adequately
irrigate 97.5 acres of alfalfa with 60 shares of CC Ditch water." R. 6319, third
paragraph.
17. The aspects of PR -6 regarding topsoil handling and the detailed 10-
year plan for revegetation using alfalfa were worked out with NRCS and the
Morgans. R. 7321:15- 7323:17; 7381:9 -13. PR -6 included plans to use a
particular species of alfalfa requested by the Morgans. R. 7321:21- 7322:22;
Proposed Decision and Findings of Compliance, R. 7818, last paragraph.
18. In August 2008, Walsh Environmental Scientists and Engineers, LLC
prepared a report ( "Walsh Report") (R. 2615 -43), to evaluate the Bench 1 material.
The Walsh Report, upon which DRMS relied in approving TR -57 in March, 2009,
concluded that the Bench 1 material was suitable for use as subsoil on the
easternmost 20 acres of the Morgan property. R. 7366:11 -18; 7385:12- 7388:22.
This conclusion that the Bench 1 materials met prime farmland standards specified
by David Dearstyne at NRCS in direct communication with the Walsh scientist.
{00145923 2 } 9
