resulted in two site inspections each year with additional site visits occurring during maintenance <br />work. <br />Previous Termination of Jurisdiction <br />The Division released jurisdiction on all privately held land within the former Coal Basin Mine <br />permit boundary on February 1, 2008. The private property is owned by Acacia, LLC, and includes <br />all the private property previously owned by MidCon Realty, LLC within the former Coal Basin <br />permit area. A description of the lands can be found in the Findings of Compliance and Proposed <br />Decision for Termination of Jurisdiction (SL -1) findings document. <br />Public Notice and Public Comments <br />Beginning July 18, 2013, the Division published notice of the termination of jurisdiction for the <br />federal lands in the Glenwood Springs Post Independent once weekly for four consecutive weeks. <br />Also notified about the Division's intent to terminate jurisdiction were the Pitkin County <br />Commissioners, Pitkin County Planning, Office of Surface Mining Reclamation & Enforcement, <br />White River National Forest, Bureau of Land Management, Acacia, LLC and the Crystal Valley <br />Environmental Protection Association ( CVEPA). The Division received comments from the CVEPA. <br />The Division conducted a final site inspection on July 22 -23, 2013. The Forest Service and the <br />Crystal Valley Environmental Protection Association were invited to attend the inspection. Two <br />representatives for the U.S. Forest Service attended a portion the final inspection and no one from <br />the CVEPA was able to attend. <br />Completion of Minimum Liability Period <br />The last reclamation and seeding was done in 2001; therefore, the 10 -year liability period has <br />expired. <br />Revegetation Success <br />Division staff sampled vegetation at some of the reclaimed areas in July 2013. The sampling plan <br />was limited to disturbances that were approved under Permit No. C- 1981 -017, were reclaimed by <br />the Division, not located on private lands, were not recently re- disturbed by Forest Service <br />reclamation efforts, were accessible by hiking and did not pose unnecessary risk to the sampling <br />team. These criteria limited the sampling areas to the eastern side of the Sutey Pile, Roads D, E and <br />the lower elevation of Roads C and G. The vegetation sampling data is on page 19 of this document <br />and the sampling location map is on page 22. <br />Cover and production data were taken on the Sutey Pile.
