Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Division has issued a proposed decision to terminate jurisdiction for the Coal Basin Mines <br />(Revoked Permit No. C- 1981 -017). Enclosed is the Division's decision form and written <br />findings. The proposed decision will be published in the Glenwood Springs Post Independent, as <br />soon as possible. Publication of the notice initiates a thirty -day public comment period. If there <br />are no requests for an adjudicatory hearing within the thirty days, the decision will become final. <br />The Coal Basin Mine is a permit revocation/bond forfeiture site located four miles West of <br />Redstone, Colorado. The permit area under consideration for termination of jurisdiction consists <br />of 10,981 acres. All of the surface acreage is public property managed by the U. S. Forest <br />Service. The Bureau of Land Management leased coal to Mid- Continent Resources during the <br />life of the mine. The termination of jurisdiction process was initiated by the Division following <br />expiration of a ten year liability period and upon completion of vegetation sampling at the site. <br />As provided by Rule 3.03.2(6), should you object to the Division's proposed decision, you may <br />request an adjudicatory hearing. <br />As part of the termination of jurisdiction process, the Division is requesting written concurrence <br />from the surface land and mineral management agencies acknowledging the completed <br />reclamation work and acknowledging that the Division will no longer be involved with <br />reclamation activities at the mine site. Since the U.S. Forest Service is the land management <br />agency for the remaining permit area, and BLM was the mineral management agency, we are <br />requesting concurrence from both agencies.
