we couldn't pay it any way. We are trying to exercise our rights under this program that was <br />suppose to protect us and our property and failed to do so. This farm is our lives, this farm is our <br />only livelihood and has been Mr. Morgans for 59 years and will continue to have to support his <br />family as well as ours. When these soils were stolen, DRMS did nothing to bring them back <br />even though I had them on the phone at that very moment. It was months before they addressed <br />the issue. Also, they had prior documentation ahead of the actions that this was prime farmland <br />and they did not do their job and then they failed to make the mine do their job. This is all <br />documented and cannot be disputed, they have everything I have. No sir, we do not know all of <br />these laws, but we do know what we are guaranteed under this Colorado Regulatory Program that <br />governs surface coal mining and we do know what we are promised in its contents. <br />Therefore, if it pleases the court, we are again pleading for the right to be heard and allowed to <br />present our case before a court.
