Accordingly, dewatering is required to <br />continue during the terms of this approval. At least three years prior to completion of <br />dewatering, a plan must be submitted that specifies how the post pumping dewatering <br />depletions (including refilling of the pit) will be replaced, in time, place and amount If <br />dewatering of the site is discontinued, the pit would fill and cause additional depletions to <br />the stream system due to increased evaporation. <br />8. Accounting of water in this plan, including excavating area, area of actual groundwater <br />exposure, pumping for dust control, mined product, lagged stream depletions, and <br />replacement water deliveries must be provided to the Water Commissioner and Division <br />Engineer on forms and at times acceptable to them. Said accounting must be emailed to <br />the Division Engineer ( Div2Ground.Water(a-b-state.co.us) and the Water Commissioner <br />(Pete. Kasper @State.co.us) by the 10 of the month following the month being reported. <br />The name, mailing address, and phone number of the contact person who is responsible for <br />operation and accounting of this plan must be provided on the accounting forms. <br />9. Should this substitute water supply plan expire without renewal or be revoked prior to <br />adjudication of a permanent plan for augmentation, all excavation of product from below the <br />water table, and all other use of water at the pit, must cease immediately. <br />10 This substitute water supply plan may be revoked or modified at any time should it be <br />determined that injury to other vested water rights has or will occur as a result of this plan. <br />11. Should a request for renewal of this plan be needed, such renewal request must be <br />submitted to this office with the statutory fee of $257 /gravel pit at least 45 days prior to the <br />expiration date of this plan (December 17, 2015). Please note that this condition was <br />not complied with for this renewal application and the applicant shall be put on <br />notice that any renewal request for this SWSP received after December 17, 2015 will <br />be subject to the application fee for a new gravel pit SWSP at that time ($1,593 at the <br />time of this approval). <br />12. Acceptance of these conditions is assumed unless a letter to the contrary is received by this <br />office, the Division 2 Engineer (Steve Witte, 310 East Abriendo, Suite B Pueblo, CO 81004) <br />and the Water Commissioner (Pete Kasper, Pete.Kasper @State.co.us) within two weeks of <br />your receipt of this letter. <br />Please contact Caleb Foy in Denver at (303) 866 -3581, or Charles DiDomenico, <br />Augmentation Coordinator, in Pueblo at (719) 542 -3368, if you have any questions concerning <br />this approval. <br />
