tom. <br />The Colorado program provides for review of proposed permitting decisions in Section 34 -33- <br />119, titled Permit application decisions of the office - appeals. This provision requires: <br />(4) The office shall publish notice of the proposed decision in a newspaper of general <br />circulation in the locality of the surface coal mining operations once a week for-two <br />weeks following issuance of the proposed decision. Any person with an interest which <br />may be adversely affected by the proposed decision may request a formal hearing before <br />the board'on the proposed decision. Such request must be made within thirty days of first <br />publication of the proposed decision of the division, be in writing, and state with <br />reasonable specificity the reasons for the request and the objeotioris to the proposed <br />decision. <br />DRMS issued a proposed decision of PR -6 on August 25, 2010. OSM cannot review PR -6 <br />because the State's decision is not yet final. I understand that you have filed an appeal of the <br />State's proposed decision: It is appropriate that you raise your concerns with PR -6 in the State <br />appeal process. <br />If you do not agree with the actions taken by this Office. concerning your complaint, you have <br />the right under 30 CFR 842.15 to request an informal review,of the'actions taken. The 'request <br />should contain statements of how and why you may be adversely affected and why you believe <br />GSM's actions merit the informal review.
