well aware that we do not have a fax nor do we have an e-mail, This seems a little bit one -sided <br />and also Western Fuels attempt to decide what facts could be talked about and what facts were <br />relevant to the case. Anything in PR -06 that is documented should be permitted. <br />We have tried several times prior and after to contact the Attorney General Office, but are told <br />that the ones we need to speak to are unavailable. We have been blocked from calls to the <br />Division which was the only contact number available. We tried Western Fuels Attoney, but his <br />office was also closed for the day. <br />We are requesting relief in all of these issues because 90% of PR -06 involves our property. <br />Another formal hearing has been requested and submitted with approximately 35 signatures. We <br />will again be returning to Denver for a formal hearing because this time you have recognized <br />JoEllen Turner and Michael Morgan as the objectors and next time we will be representing Mr. <br />And Mrs. Morgan and proper papers have been filed with the Division at the beginning to allow <br />JoEllen Turner and Mike Morgan to represent Frank and MaryLou Morgan at which time new <br />evidence will be available and submitted. Michael Morgan is Frank Morgan son and will <br />eventually have this place and I have leased it for 19 years doing the farming. <br />We are requesting relief from the Board because this evidence has not come back from out of <br />state soil scientist, soil analysis, etc. which cannot be presented at this time as part of the exhibits <br />or documentation. <br />We are again requesting relief. We are farmers, we are not attorneys and should not have to be. <br />Our public comment period does not even end until November 15, 2010. We are being requested <br />to furnish information and documentation that is not available at this time. This does not seem <br />to protect our rights under the rules and regulations of the Colorado Regulatory Program. We <br />have been given a week since were even told that the proceedings begin 30 days after the first <br />objection was filed. This is a formal hearing. This is our right to have and should be informed of <br />all of these rules and regulations. We are every day people living in a very small community that <br />is 2 hours from anywhere and as farmers, we should not be treated as attorneys. We should, <br />however, be given equal rights as citizens and as individuals to present to the Board whatever <br />materials and evidence that we have that pertains to this Permit Revision that directly affects our <br />property. If we are refused an extension, then materials will be faxed to the Division or the <br />Attorney Generals office before close of business on Monday, however, they will not be three <br />hole punched since faxes do not do that, but we are not going to be disallowed just because that <br />reason. The time frames that are being requested of us is unjust and we are again requesting <br />relief and assistance here. The Colorado Regulatory program is suppose to protect us and our <br />rights, instead they are helping and assisting the Operator and we are being left out. We will fax <br />all of this on Monday the8th, 2010 and we are showing good cause for an extension. We are <br />farmers, not attorneys and this should not be treated a judicial review but as a formal hearing <br />allowing us to submit our evidence.
