53 <br />1 In 1993, Tony Waldron and Harry <br />2 Ranney designated the Barx soils as being prime <br />3 farmland soil if irrigation was available. Mr. <br />4 Morgan is the largest shareholder of CC ditch. <br />5 And we have always -- I think you <br />6 have documentation in front of you -- where's my -- <br />7 you have documentation in front of you from the soil <br />8 conservation plans that Mr. Morgan has historically <br />9 irrigated and cropped this property since 1960 and <br />10 that the Barx soil is prime farmland soils. <br />11 When western Fuels entered that <br />12 property, they did not have a prime farmland <br />13 investigation done. They did not have any plans -- <br />14 reclamation plans, soil salvage plan, soil <br />15 redistribution plans, or anything in place prior to <br />16 entering that property. <br />17 They removed our Barx soils to the <br />18 Benson property, which is also documented in PR 06. <br />19 We have our soils here. You guys each get a little <br />20 bag of dirt. <br />21 This is the B lift (indicated). I'll <br />22 try to spread this stuff around. This is the <br />23 substitute soil that they want us to accept <br />24 (indicated). All of our -- all of our soils are -- <br />25 the Barx soils were down 72 inches deep in places. <br />
