The Division discussed this discrepancy with the Operator (see attached <br />correspondence) prior to the submittal of this Amendment Application and instructed the <br />Operator to provide a summary of the additions and deletions to the permit area along with <br />the associated permitting actions. A review of the Amendment Application found that no <br />such summary was provided. In order to correct any potential errors that were made in the <br />permit file, the Operator must provide an accounting summary which demonstrates that the <br />permit area is currently 270 acres. Please respond. <br />6.4.1 Exhibit A — Legal Description <br />No comments. <br />6.4.2 Exhibit B — Index Map <br />No comments. <br />6.4.3 Exhibit C — Pre - Mining and Mining Plan Map(s) of Affected Lands <br />4. The map submitted for Exhibit C has a scale of 1 inch equals 660 feet. However, the scale <br />bar on the map is not equal to an inch, but rather measures to 9 /10th of an inch. Please <br />confirm that the map is set to the specified scale or revise the Mining Plan Map accordingly. <br />5. The Mining Plan Map depicts the various phases of mining and reclamation. Please specify <br />the acreage values associated with each of the phases. <br />6. The Mining Plan Map contains date ranges for each of the phases. Please clarify if these date <br />ranges apply to quarry operations or backfill operations. <br />7. Please outline and label all major surface features such as equipment storage areas, existing <br />and proposed roads, overburden stockpiles and product stockpiles. <br />6.4.4 Exhibit D — Mining Plan <br />8. The Applicant has stated that overburden will be backfilled to a minimum depth of two feet. <br />Please specify the average depth to which overburden will be replaced; this information is <br />required to calculation the required financial warranty for the site. <br />9. Please clarify if overburden will be immediately hauled from the quarry area to the active <br />backfilling phase and backfilled, or if it will stockpiled for any period of time before it is <br />backfilled. If the overburden will be stockpiled, then please specify the location of the <br />stockpile and the approximate volume of overburden to be stockpiled at any given time. <br />10. According to the Mining Plan Map, current quarry operations are occurring with Mining <br />Area A3. Please confirm that active quarry operations are only occurring in Mining Area A3. <br />11. The Mining Plan states that once backfilling is complete in Backfill Area 1 (BFI), backfilling <br />will then proceed to BF II, BF III, BF IV, etc. However, the Mining Plan also states that <br />when backfilling is complete in Mining Area 2, backfilling will begin in BF II and then <br />
