Map codes 7, 8 and 12 are located along Hubbard Creek beyond the
projected angle of draw. Decreed water right No. 6 is located outside the
permit boundary and will not be affected by mining. Water right no 13, Reds
spring and pipeline, is within the permit boundary but outside of the area
affected by mining. The water rights along old State Highway 133 should not
be adversely effected by the mining operation because these water rights are
in a formation that is geologically at least 800 feet below the mine workings.
The J & M Springs & Pipelines are claimed for domestic and stock watering
purposes. Water right numbers 1 and 3 are decreed for gallons per minute.
Number 2 is decreed for 2 gpm. Numbers 4 and 5 are decreed for 5 gpm.
Leonard Springs Nos. 1 & 2 are decreed for 22.4 gpm
(aKiii) The narrative in Section 2.04.7(3) discusses the impact the mining operation
could have on the quantity of surface and ground water within the permit and
adjacent area. This impact is restricted to potential depletion of water from
the springs and ponds and surface streams. Limited extraction will be
utilized to protect Pond #1. The other ponds are either not within the
projected angle of draw or in an area where there is sufficient overburden to
minimize the risk of subsidence induced damage. No measures are
proposed to protect the springs because the likelihood of damage to the
springs by the mine operation is considered minuscule.
The applicant has alternative sources of water to mitigate the impact mining
may have on the quantity of surface and ground water within the permit and
adjacent area. The applicant controls 3,750 shares of Class I and 960
shares of Class 11 stock in the Deer Trail Ditch Company and 782 shares of
Class 11 stock in the Fire Mountain Canal. The applicant also controls the
right to use 0.5 cfs decreed to the Deer Trail Ditch for power and mining
purposes with date of appropriation of February 15, 1907.
(a)(iv) The proposed floor elevation of the mine entries at the portal is 6878 feet.
Map 10, Upper Perched Water Zone - Mesa Verde Formation, shows the
elevation of the ground water in the vicinity of the portal to be above the
proposed portal elevation. Therefore, gravity discharge of water from the
portals is possible. See section 2.05.4(2)(g) for portal sealing options.
MR -130 2.05-102 06/18/12
