Dan Hernandez, also with the Division, accompanied me on the inspection. The <br />main reason for the inspection was to meet with the operator and a landowner who has filed several objections to <br />the Terror Creek Loadout's Permit Renewal 06. The main issue in the objection is the location of the security gate <br />at the main entrance to the Loadout. Also present for the inspection were Julie Murphey, from the Attorney <br />General's Office and representing the Division, Mike Ludlow, Jim Kiger and Mike Dawson, representing Terror <br />Creek, LLC and Colin Hutto and Alan Hassler, representing the landowner. The weather was cool and snowy and <br />the ground was wet and partly covered with snow. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />- The inspection focused on the current and former location of the Loadout's security gate as it relates to two <br />access points for the adjacent landowner. The current location of the gate is at the top of the haul road adjacent to <br />old Colorado Highway 133. The road is within the Terror Creek Loadout's permit boundary and is not creating <br />any environmental issues. The former location of the Loadout gate is just below the turn-off to the Loadout office <br />and shop. The haul road to this point (and below to the facilities area) is a paved road. The road is well <br />maintained and stable and no issues were noted. There are two openings in the haul road's guard rails. One is just <br />"above" the point where the old gate was located and one is just "below" where the old gate was located. <br />DOCUMENTS RECEIVED: None <br />This concludes the 9 January 2014 partial inspection report for the Terror Creek Loadout. <br />
