The Division of Reclamation Mining and Safety (Division) has reviewed the Western Fuels— Colorado (WFC) responses to
the Division's review of the 2011 and 2012 Annual Reclamation Reports (ARR) for the New Horizon Mine. WFC has
addressed most of the concerns with remaining few to be addressed in future ARR submittals.
2011 Annual Reclamation Report

3. The acreage total for the dryland pasture seeding is inconsistent with the acreages given on Exhibit 2011 -4. Please
verify the acreages and correct the total acreage in the 2013 ARR.
4. WFC has committed to submitting seed tags for the corresponding seed mixes used reclamation in future ARRs.

8. The acres listed on the ARR form are inconsistent (one example is: total acres disturbed is more than the acres
disturbed for the entire life of mine). Please note this and other inconsistances and make corrections on future

11. Legible copies of the soil and subsoil tests in Attachment 2011 -A were submitted. The test results were compared to
Tables 2.05.4(2)(d) -1A and -16 of the New Horizon permit. All topsoil and subsoil results were within the thresholds
approved in the permit.
12. Item resolved. WFC has updated Map 2.05.4 -4 with PR -8. In future ARR's please confirm that the information
provided on Exhibit 6 is consistent with the updated map.
