STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866 -3567
FAX: (303) 832 -8106
February 7, 2014
Chris Gilbreath
Colowyo Coal Company L.P.
1100 West 116th Avenue
Westminster, CO 80234
Re: Colowyo Coal Mine (Permit No. C- 1981 -019), MR- 131 adequacy issues
Dear Mr. Gilbreath:
COLORADO
ID IV I S I O N O F
RECLAMATION
MINING
SAFETY
John W. Hickenlooper
Governor
Mike King
Executive Director
Loretta E. Pineda
Director
We received your minor revision application (MR -131) to revise the location of the haul road to South
Taylor Pit and revise the spoil grading map in your Permit Application Package, and your application
was deemed complete on February 7, 2014.
I do have an adequacy issue. Please revise the spoil grading plan or explain why the years for
completion on several parcels on the grading map have been pushed back to year 2024 or later. I have
discussed this with Tony Tennyson, but am not convinced that these dates make sense in light of Rule
4.13, Contemporaneous Reclamation. Perhaps smaller parcels could be graded at later dates for such
things as road corridors and storage areas, but some of the parcels (for example, the 2025 - 2026 parcels)
are very large, as much as a half -mile wide.
As for hydrology, the current grading and reclamation schedule was shown in hydrologic analyses to be
sufficient for the channels and ponds, but if you need to increase channel or pond sizes or add an
additional pond higher in the watershed we can discuss this.
If you have any questions, please contact me at extension 8113 (phone number above) or
Rob.Zuber @state.co.us.
Sincerely,
Robert D. Zuber, P.E.
Environmental Protection Specialist
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
