PERMIT #: M- 2012 -004 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: February 5, 2014 <br />OBSERVATIONS <br />This inspection was conducted by Eric Scott of DRMS as a routine monitoring inspection of the 110c North Star <br />Pit. Permittee representative Jack Miller was present during the inspection. The pit is located in an area that <br />is still being actively farmed, and the site identification sign was present near the access point to the site at <br />county road 138. <br />The disturbed area associated with the mining activity to date was outlined by a ditch visible on the attached <br />aerial photo. The outline of the disturbed area to date has been measured from aerial photography at <br />approximately 12.5 acres. The attached map shows the existing boundary defined by the ditch and disturbed <br />area as a yellow line. <br />The currently approved permit boundary as constructed from the legal description and maps submitted in the <br />permit application is shown on the attached map as a red line. As can be clearly seen on the attached map, <br />the location of the disturbed areas and access road observed during the inspection, do not correspond with <br />the permit boundary approved by the Division. There are currently several acres of disturbed area that are <br />outside of the approved permit boundary shown in red. <br />As stated on the first page of this report, DRMS will allow until May 2, 2014 (2 year anniversary of the 110c <br />permit issuance date) for the permittee to submit a complete 110c to 112c permit conversion application to <br />incorporate (at least) all the currently - disturbed area into a new permit boundary: If a complete amendment <br />has not been received by the Division by May 2, 2014, the Division will initiate enforcement action for the <br />disturbance of areas outside of the approved permit boundary.
