2/7/2014 State.co.us Executive Branch Mail - Fwd: 1 -29 -2014 EFCI mid -term re\iewresponse
Zuber - DNR, Rob <rob.zuber @state.co.us> Thu, Feb 6, 2014 at 5:19 PM
To: Mary Rodriguez - DNR <mary.rodriguez @state.co.us >, Alysha Hernandez - DNR
<alysha.hernandez @state.co.us >, David Berry - DNR <david.berry @state.co.us>
Mary/Alysha -
Please file this under Southfield MT6 and name it "E -mail from Dr. Corley on well issue." Dave is that ok with
you?
Thanks,
Rob
David, Rob, John, and George.
I note the Jan. 29, 2014, mid -term response from George Patterson with regard to The Corley Co. water well. I would like to
comment about some of George's statements. With regard to the cause of the decreased production of the well, it was not
possible in 1992 when George states that Al Weaver and our representative tested the well to be dry to determine the
cause, but EFCI was illegally pumping water fromthe nearby north well (now MWNW) without a permit until 1994. Since
our well was mapped on the Southfield Mine Map incorrectly until 2013, I believe that the assurances that EFCI's
hydrology consultant gave us in 1992 were based on the incorrect well location. They assured us that Southfield mining
could not have possibly affected our well, and I relied on their expert opinion at the time. As for possible subsidence, our
well pit is a large above ground concrete structure that should have been monitored for subsidence. It is not possible now
to document subsidence. However, I believe that George is incorrect that the well is over a barrier pillar. All of the
Southfield Mine Maps including the small area map supplied by George with the above stated mid -term response clearly
shows our well location to be directly above the portion of removed pillar in the mined panel. It is definitely not over a
solid barrier pillar. Both monitoring point I and our well are directly above formerly solid pillars that were removed on the
retreat mining. Further, Mine Plan Map 17 shows the barrier pillar to be entirely within the projected angle of draw. As for
the release in 1994, our well had been ruined by that date, and we signed the release in order for EFCI to try to obtain a well
permit. Had we refused to sign the release in 1994 we would have only hurt the Southfield mining activities and would
have not helped restore our well.
With regard to Al Weaver's subsidence monitoring report, I did not see any mention of the surface subsidence crack
features over the 1 East panel that were repaired in about 2011. There are other surface cracks that I have mentioned that
we have found without reporting their location because of the poor repair of the Moose Panel cracks. That repair did more
damage to the area than good; please note that I suggested hand shovels instead of a dozer because of the very steep side
slope. At least Al's report gives us some credit for assisting with this crack repair.
The Illustration I Corley Co. Well Location Map has another error of the location of a fence corner that has been pulled
out from subsidence. This map shows a fence corner at approximately 14000 ft. N and 10000 ft. E. The map says that this
location is according to Corley. No, the corner on the ground is at the East quarter corner of Section 24, T20S R70W at
approximately 12650 ft. N and 9950 ft. E.
After reading the EFCI mid -term response perhaps we should rethink our offer we made yesterday to compromise our
https: / /mai l.g oog le.conVmai 1 /u /0 / ?ui =2 &i Ire29129fcb5 &view= pt &search =i nbox&th= 14409b6dl3c387a8 1/2
