Pineda <br />Director <br />Re: New Horizon Mine (Permit No. C- 1981 -008) <br />Proposed Decision Permit Revision No. 8 (PR -8) <br />Revision of prime farmland reclamation practices including topsoil redistribution and <br />revegetation plans. <br />Dear Ms. Turner and Mr. Morgan: <br />This letter is to inform you that the Colorado Division of Reclamation, Mining and Safety is <br />proposing to Approve Permit Revision No. 8 (PR -8). The application was submitted by Western <br />Fuels- Colorado, LLC for the New Horizon Mine. In accordance with Rule 2.07.4(2)(c) of the <br />Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining, we are <br />providing notice of this proposed decision. <br />Any person with an interest which may be adversely affected by the proposed decision may request <br />a formal hearing before the Mined Land Reclamation Board within thirty (30) days of the first <br />publication of this notice in the San Miguel Basin Forum. Such request must be made within thirty <br />(30) days of the initial publication of this notice, must be in writing, and must state with reasonable <br />specificity the reasons for the request and the objections to the proposed decision. <br />A copy of the proposed decision is enclosed and is on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman <br />Street, Denver, Colorado 80203 and at the Montrose County Courthouse, 300 Main Street, Nucla, <br />CO 81424. <br />If you have any questions, please contact me. <br />Sincerely, <br />David A.
