Hickenlooper <br />Governor <br />Mr. Brian Watterson <br />Moffat County Mining, LLC <br />Mike King <br />29515 Routt County Road 427 <br />Executive Director <br />Oak Creek, CO 80467 <br />Loretta Pineda <br />Director <br />RE: Williams Fork Mines; Permit No. C- 1981 -044 <br />4t" Quarter 2013 Refuse Pile Inspection Report Review <br />Dear Mr. Watterson, <br />The Colorado Division of Reclamation, Mining and Safety (Division) finds the above referenced refuse pile <br />inspection report for the 4th quarter of 2013 to be in compliance with the following rules: <br />4.10.2(1) — The mine waste bank was inspected, on behalf of the person conducting surface coal mining <br />operations, by a qualified registered engineer. The report indicates no materials were placed on the <br />surface waste pile; also the 49 excavation waste disposal area was reclaimed in 2009. The submitted <br />inspection report complies with the inspection requirement of rule 4.09.1(11). <br />4.10.2(2) <br />• (a) — The inspection occurred quarterly as required by the Division. <br />• (b) — Inspections included observations and tests necessary to evaluate the potential hazard to <br />human life and property and to ensure that all organic material and topsoil have been removed <br />and the proper construction and maintenance are occurring in accordance with the plan submitted <br />under 2.05.3(8) and approved by the Division. <br />■ The note on the submitted report indicates that the mine has been inactive since 1995 and <br />that no material has been placed on the surface waste pile. Also noted was that the old 49 <br />excavation was reclaimed with demolition material in early 2009. Stability of the waste <br />disposal areas was inspected and problems were not identified. <br />• (c) — The engineer considered steepness of slopes, seepage, and other visible factors which could <br />indicate potential failure. <br />■ Stability of the waste disposal areas was inspected and problems were not identified. <br />• (d) — Copies of the inspection findings shall be maintained at the mine site. <br />■ Please retain copies of the waste pile inspection report at the mine site. <br />4.10.2(3) — No potential hazards were noted in the fourth quarter 2013 refuse pile inspection report. <br />If you have any questions, please feel free to contact me. <br />Sincerely, <br />Jared Ebert <br />Environmental Protection Specialist <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
