No representative of New Elk Coal Company (NECC) was present. The weather was fine, <br />although there was still snow on the ground from a storm the preceding weekend. Two permitting actions are in <br />progress, these are detailed under the heading GENERAL MINE PLAN COMPLIANCE. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The records were available in the Technical Services building at the New Elk Mine. Detailed comments <br />are made at the end of this report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.053; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The bales in the erosive area at the north edge of the disturbance boundary were in place. <br />GENERAL MINE PLAN COMPLIANCE: <br />TR57 is in progress. The proposed decision due date has been extended to January 31, 2013. The Division <br />is waiting on a response to the last adequacy review. <br />An application for Permit Renewal (RN6) was received on December 19, 2013.
