Page 2 <br />any piezometers on site and/or has there been any groundwater level monitoring conducted to date? If not, <br />DRMS will require the installation of water level monitoring wells sufficient to determine potential impacts <br />to surrounding non - permitted properties. Bestway will also need to provide a groundwater level monitoring <br />and mitigation plan for DRMS approval. These plans typically require at a minimum: proposed (or <br />existing) well locations and construction logs, any available baseline water level data for the immediate <br />area, a groundwater level monitoring plan, a mitigation plan to eliminate adverse effects if any are <br />observed(such as a French drain to eliminate mounding/shadowing, re- drilling water supply wells impacted <br />by dewatering activities, etc.), and proposed trigger levels for groundwater elevations, ideally based on <br />available baseline data, that will require mitigation activity to be initiated. DRMS did not note a <br />groundwater monitoring/mitigation plan referred to in this amendment or present in the site file; therefore, <br />Bestway will need to provide a groundwater monitoring and mitigation plan as part of this amendment. <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): <br />This is only a comment for consideration with regard to the bonding of the proposed slurry wall. In order to <br />qualify for the 20% bonding option, Bestway will need to submit to DRMS, for review and approval prior to <br />installation, a certified slurry wall design, including QA /QC testing protocols to insure that the proposed <br />design is met. This would then need to be followed up after the slurry wall installation with final "as- builts" <br />and QA/QC documentation showing that the slurry wall was installed to the approved specifications. <br />Otherwise, Bestway will be required to bond for the full amount of the slurry wall at a rate of $3 per square <br />foot. However, if Bestway installs the slurry wall and gets it fully approved by the SEO before any <br />groundwater is exposed, then no bond for the slurry wall would be required. <br />This concludes the Division's preliminary adequacy review of this application. This letter shall not be <br />construed to mean that there are no other technical deficiencies in your application. Other issues may arise <br />as additional information is supplied. Please remember that the decision date for this amendment <br />application is April 16, 2014. As previously mentioned, if you are unable to provide satisfactory responses <br />to any inadequacies prior to this date, it will be your responsibility to request an extension of time to allow <br />for continued review of this application. If there are still unresolved issues when the decision date arrives <br />and no extension has been requested, the application will be denied.
