The September 1992 Asset Purchase Agreement did not include the mine site. <br />Consequently, transfer of Permit No. C -80 -003 was inappropriate, and Hayden <br />Gulch Terminal, Inc. submitted a new application (dated December 14, 1992) <br />to operate the coal loading facility pursuant to the Regulations of the <br />Colorado Mined Land Reclamation Board for Coal Mining. <br />Operation Plan <br />The Hayden Gulch Loadout is a coal handling facility. There are no coal <br />resource removal operations occurring or anticipated within the permit <br />area. <br />At the time of the December 1992 permit application submittal, HGTI <br />anticipated coal shipment (via rail or truck) commencing as early as June <br />1993. Permits or permit applications required to operate the loadout <br />facility were transferred from the previous owner (H -G Coal Company) <br />through the applicable regulatory authorities. The coal handling capacity <br />(railcar or truck loadout) remained at 1.0 million tons per year. The <br />Colorado Division of Minerals and Geology (CDMG, the immediate precursor to <br />CDRMS) approved the permit application and loadout operations plan as <br />Mining and Reclamation Permit C -92 -081 on May 22, 1993. <br />The loadout system approved by CDMG under Permit C -92 -081 includes the <br />following components: <br />• An existing truck -dump hopper with a 75 -ton bin. <br />• An existing 36 -inch reclaim conveyor, housed in a corrugated metal <br />tunnel, which transports coal to an existing crusher, housed in an <br />existing crusher building. <br />• An existing 36 -inch conveyor, which is used to elevate the coal from <br />the crusher to the top of a radial stack tube which is used to feed a <br />50,000 ton stockpile. <br />• An existing 36 -inch reclaim conveyor, housed in a concrete reclaim <br />tunnel, elevates the coal from the 50,000 ton stockpile to the <br />existing loadout building (with a 75 -ton loading bin and loading <br />chute) . <br />• <br />MR -16 2 Revised 11/07 <br />
