This will create long term injurious stream depletions if not <br />adequately replaced. In accordance with the letter dated April 30, 2010 (copy attached) from <br />the Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel mining <br />operators must comply with the requirements of the Colorado Reclamation Act and the Mineral <br />Rules and Regulations for the protection of water resources. On December 5, 2012, DRMS <br />received and accepted an increased bond for this site to cover the cost of lining or backfilling in <br />accordance with options 1 and 3 of the April 2010 letter. The Duckworth Pit now has an actual <br />surety amount of the required surety amount of $1,603,000 which can be used to eliminate long <br />term augmentation requirements by lining or backfilling the site should the pit operator or land <br />owner fail to obtain a sufficient augmentation plan after mining operations are complete. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2013 through October 31, 2014, <br />unless otherwise revoked, modified, or superseded by decree. A SWSP renewal request <br />must be submitted to this office with the statutory fee (currently $257) by August 1, <br />2014. <br />2. Well permit no. 76922 -F was obtained for the Duckworth Pit, however such well permit <br />limits production to 500,000 tons of mined material which is less than the amount <br />requested under this SWSP. Prior to mining more than 500,000 tons of material per year <br />the Applicant must obtain a new well permit. Should this permit be denied for reasons of <br />600 foot spacing, or any other legitimate reason, approval of this SWSP may be <br />cancelled. <br />3. The total surface area of the groundwater exposed at the site must not exceed 0.88 acres <br />from November through January and 1.15 acres from February through October, <br />resulting in evaporative losses of 2.86 acre -feet for this plan period. <br />4. The total amount of water used for dust control at the site must not exceed 6.24 acre - <br />feet. All pumping for dust control shall be measured with a totalizing flow meter to the <br />satisfaction of the Division Engineer. <br />5. The total amount of water lost in aggregate production at the site must not exceed 8.81 <br />acre -feet from 599,000 tons of mined aggregate. <br />6. Total consumption at the site must not exceed the aforementioned amounts unless an <br />amendment is made to this plan. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />8. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. The release of replacement water may be aggregated to <br />maximize beneficial use. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />9. Dewatering operations must be measured by totalizing flow meters that can accurately <br />show the monthly volume of water dewatered into the silt pond, Lighthouse Cove Pond <br />
