Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Dick Wolfe, RE <br />Director /State Engineer <br />RECEIVED <br />JAN 2 8 2014 <br />Division of Reclamation, <br />Mining & Safety <br />We have reviewed your letter dated October 4, 2013 requesting a substitute water _supply <br />plan ( "SWSP ") in accordance with § 37 -90- 137(11), C.R.S., to cover depletions caused by mining <br />op re ations at the Duckworth Pit operated by Martin Marietta Materials ( "MMM" or "Applicant ") along <br />Boulder Creek. The required fee of $257.00 for the renewal of this substitute supply plan has <br />been submitted (receipt no. 3662040). The SWSP was originally approved on July 20, 2005, <br />and was most recently renewed on December 24, 2012. <br />Plan Operation <br />This SWSP covers depletions caused by sand and gravel mining operations at the <br />Duckworth Pit. Mining operations commenced in November 2012 and are projected to occur in <br />two phases over a period of four to five years. During this plan period it is expected that the <br />exposed ground water area will vary from 0.88 acres to 1.15 acres as shown in attached Table <br />1. Dewatering will occur to allow for dry mining at the site. Operations that will consume water <br />include exposing ground water, dewatering, mining and removal of product, and dust control. <br />Replacement water will come from water stored in priority in Heaton Reservoir, dewatering <br />credits from the Duckworth pit, changed Rural Ditch shares and excess accretions from MMM's <br />South Platte Combined SWSP (WDID 0202581). <br />Under this SWSP the Applicant also sought to divert changed Rural Ditch shares from <br />Heaton Reservoir for use at the Del Camino Batch Plant and replace depletions from out -of- <br />priority storage in Heaton Reservoir. Such operations cannot be approved under a SWSP <br />approved pursuant to § 37 -90- 137(11), C.R.S. Therefore, prior to diverting changed Rural Ditch <br />shares for use at the Del Comino Batch Plant, or storing water in Heaton Reservoir out of <br />priority, the Applicant must obtain a SWSP pursuant to § 37 -92 -308 or a court approved <br />augmentation plan. <br />Depletions <br />Evaporation and Mining Operations <br />Net evaporative depletions are calculated using a gross annual evaporation of 40 inches <br />per year per NOAA Technical Report NWS -33.
