Rule 2.03.10 — Identification of Other Licenses and Permits <br />2. During the Division's quarterly records check on complete inspections it has been <br />noted the West Elk Mine's CDPS permit expired in 2009. There is a letter in the <br />file that West Elk is currently operating under administrative extension until a new <br />permit is issued. Please provide the Division with a discussion on the status of the <br />mine's CDPS permit. <br />Rule 2.04. 10 — Vegetation Information <br />3. Pursuant to Rule 2.04.10(5), please review the Delta and Gunnison County <br />threatened and endangered plant species lists and update this section if necessary. <br />If there are any new listed species, a new on the ground survey will be required. <br />Rule 2.04.11— Fish and Wildlife Resources Information <br />4. Pursuant to Rule 2.03.11(4), please review the Delta and Gunnison County <br />threatened and endangered wildlife species lists and update this section if <br />necessary. If there are any new listed species, a new on the ground survey will be <br />required. <br />Rule 2.05.3 — Operations Plan — Permit Area <br />5. Map 51 — E -Seam Projected Operations shows the E -Seam workings at the West <br />Elk Mine. The map shows mined areas and projected potential mining areas. <br />Please update Map 51 to show the changes to the mined areas. The <br />Division will send the recalculated reclamation cost estimate under separate cover. <br />Rule 4.02.5 — Stream Buffer Zone Markers <br />7. Please review all of the stream buffer zone markers and verify that they are in <br />place as required and that they meet the requirements of Rule 4.05.18. <br />Rule 4.05.18 — Stream Buffer Zones <br />8. The West Elk Mine permit discusses stream buffer zones on the North Fork of the <br />Gunnison River and Sylvester Gulch. Since the stream buffer zone Rule applies to <br />all perennial, intermittent and ephemeral streams with a drainage area greater than <br />one mile, please review and discuss all of the streams within the West Elk Mine's <br />Colowyo Mine <br />Permit No. C- 1981 -019 <br />10 <br />2010 Midterm Review <br />10 May 2010 <br />
