Trapper Response to Comment 2: Map M28, referenced on page 2 -170, is revised to include the <br />additional permit acreage. All of the new acreage is included in "Rangeland " and "Wildlife Habitat" land <br />uses. <br />3. Prior to any mining in the expansion area, Trapper will need to submit a narrative of the land <br />capability and productivity in accordance with Rule 204.3(2)(b). The Division will stipulate the <br />approval of this permit revision to this effect. <br />Trapper Response to Comment 3: Trapper will submit the requested narrative prior to any mining in the <br />permit expansion area. <br />4. For the proposed expansion area, please revise section 2.05 of the permit to indicate whether the <br />proposed permit area has been previously mined. If so, please submit the information required by <br />Rule 2.04.3(3). <br />Trapper Response to Comment 4: Enclosed permit page 2 -170 was revised to add a paragraph indicating <br />that there was no previous mining in the PR -7 permit expansion area <br />2.04.4, Cultural and Historic Resource Information: <br />5. On July 27, 2013 the Division received a letter from Edward C. Nichols, the State Historic <br />Preservation Officer in regards to their evaluation of the permit revision. Their letter is dated June <br />24, 2013 and is enclosed for your review. Two cultural resources have been recorded to exist <br />within the expansion area (5MF948 and 5MF7402). A discussion of these resources is included in <br />Mr. Nichols letter along with a recommendation that a cultural resources survey be completed for <br />those areas within the PR -7 expansion area. Based on a review of the current cultural resource <br />inventory included in section 2.9 in the permit, it does not appear the entire expansion area has been <br />evaluated. Rule 2.04.4(1) and (2) requires specific cultural resource information be submitted with <br />a permit application for areas proposed or likely to be affected by surface mining activities. The <br />permit revision does not indicate any area to be affected within the proposed expansion area for the <br />next permit term. Given this, the Division will add a stipulation to the approval of this revision to <br />require that a Cultural and Historic Resource inventory and survey be conducted to comply with <br />Rule 2.04.4 prior to disturbing/affecting any area within the proposed expansion area. <br />Trapper Response to Comment 5: Trapper hired contractor Grand River Institute of Grand Junction, <br />Colorado to conduct a Class III cultural resources inventory of the PR -7 pit expansion area Trapper will <br />submit the requested information prior to any mining in the permit expansion area <br />2.04.5, General Description of Hydrology and Geology, <br />6. Prior to any disturbance within the expansion area, section 2.07 of the permit will need to be <br />updated to provide the information required by Rule 2.04.5. The Division will add a stipulation to <br />the approval of this permit revision to this effect. <br />Trapper Response to Comment 6: Please see the response to comments 7 and 8. <br />
