The Division has reviewed Seneca Coal Company's July 17, 2013 response to the Division's
2012 Annual Reclamation Report review, dated June 26, 2014. The Division has identified one
remaining discrepancy on the Annual Reclamation Report (ARR) form that needs correction.
The remaining adequacy concern as stated in the Division's, June 26, 2013, letter was:
"The report indicates that 1,151.45 acres have been Phase I bond released. However, according
to the proposed decision and findings of compliance for SL3; the latest approved Phase I bond
release application, the total amount of land that has been Phase I bond released at the site is
1,134.25 acres. Seneca Coal Company needs to correct the annual reclamation report form and
cite the correct acreage amount that has been approved for Phase I bond release."
SCC's response noted that SCC sent a letter to the Division on August 11, 2010 to resolve SL2
Phase 1 bond release acreage, and SCC provided copies of this letter.
It appears that the Division did not reissue the proposed decision and findings for SL2 to revise
the acreage being released. The public notice was not re -run either. With the approval of SL2,
2010, the Division approved Phase I bond release of 721.9acres.
On March 27, 2011, the Division approved SL3, which approved Phase I bond release of 412.35.
For the reporting timeframe, January 1, 2012 to December 31, 2012, the Division has approved a
total of 1,134.25 acres for the Seneca 11 West permit.
On January 6, 2012, the Division approved transfer of 204.9 acres corresponding to the Tie -
Across Haul Road to the Hayden Gulch Load Out permit (C1992 -081).
Please correct the 2012 ARR form to correspond to the acreages that have been approved by the
Division (up through December 31, 2012).
