Pirieda <br />28755 Highway 9 Director <br />Silverthorne, CO 80498 <br />Re: Morrow/Murphy Pit, Permit M 1979 -187, Application for Transfer of Mineral Permit <br />and Succession of Operators, Revision SO -02, Incomplete Financial Warranty, Annual Report, <br />Right to Enter and Structures Agreement <br />Dear Mr. Norwick: <br />On December 30, 2013, the Division of Reclamation, Mining and Safety received Application form for Transfer of <br />Mineral Permit and Succession of Operators for Morrow/Murphy Pit, Permit No. M- 1979 -187. The following items are <br />incomplete with the application submission: <br />1. The Financial Warranty Corporate Surety provided is not an original signature of the Operator. <br />If Everist Materials, LLC has a company seal, please provide on the Financial Warranty or indicate `NO SEAL'. <br />2. The 2013 Annual Fee and Report is due by January 23, 2014 and has not been received to date. ' <br />3. The Demonstration of Legal Right to Enter is to be provided from the land owner, Murphy Mining & Minerals, <br />LLC to Everist Materials, LLC. The agreement for mineral rights is to be from Morrow & Son, Inc to Everist <br />Materials, LLC. See instructions for additional details. <br />4. Structure Agreement does apply and is required for the overhead power lines and any fences owned by <br />surrounding landowners within 200 feet of the affected mining permit area. See instructions for additional <br />details. <br />In order to complete the acceptance of this application, please return the required documents to the State at the above <br />address by March 21, 2014. I have provided a copy of the Financial Warranty provided and page 5 for Mr. Norwick of <br />Everist Materials, LLC to sign and have notary acknowledge.
