The <br />Division will continue to use a 33% failure rate in the RCE vegetation tasks. <br />If NECC believes that areas at the New Elk mine that have previously been seeded with the permanent <br />seed mix are eligible for bond release, NECC should submit a bond release application to the Division <br />for these areas. <br />• In Section 3.0, page 5, NECC states reasons substantiating why disc harrowing is not needed for <br />reclamation tasks. The Division concurs and will not include disc harrowing in the RCE revegetation <br />tasks. <br />• In Section 3.0, page 5, NECC provided additional detail regarding specific RCE tasks. <br />• The corrected East Portal Hoist House dimensions will be used to update the Demolition task. <br />• NECC provided an argument against using a drill rig to abandon shallow alluvial wells. The <br />Division concurs with this argument and will revise the sealing task for the shallow alluvial well <br />to remove the drill rig from the task. Sealing of deep well will still necessitate using a drill rig. <br />• NECC provided updated dimensions of the three Bates portal openings, the West Portal. The <br />updated dimensions will be used in the Division's RCE portal sealing and backfilling <br />calculations. <br />• NECC contends that the West Portal abandonment will not require construction of a bulkhead <br />seal in accordance with Rule 4.07.31 and consistent with 30CFR 75.1711?
