State.co.us Executive Branch Mail - Fwd: NECC permitting
Please scan this email to laserfiche and file under both MR120 and TR67 for New Elk Mine (c- 1981 -012).
Thanks,
Leigh
Leigh Simmons
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
303 866 3567 (8121)
- - -- Forwarded message - - - --
From: Ron Thompson <ronthompson @newelkcoal.cam>
Date: Fri, Jan 17, 2014 at 11:26 AM
Subject: RE: NECC permitting
To: "Simmons - DNR, Leigh" <leigh.simmons @state.co.us >, Greg Smith <gsmith @newelkcoal.com>
Leigh,
I talked with Doug and he is in agreement with withdrawing MR120 and TR67.
Ron
From: Simmons - DNR, Leigh [ mailto :leighsimmons @state.co.us]
Sent: Wednesday, January 15, 2014 12:51 PM
To: Greg Smith; Ron Thompson
Subject: Re: NECC permitting
Greg, Ron
Summarising our conversation this morning:
• Ron is going to talk to Greg and Doug about withdrawing MR120 and TR67
• RN3 is almost ready to approve -just the AVS hurdle to clear. I just need two employment end dates, see below...
• Most of the remaining permitting actions (TR57, RN6 at New Elk, TR68) have a proposed decision due date of 1/31 and will almost certainly need to be extended
• I need to write an adequacy letter for RN6 at Golden Eagle by 2/21, but I won't be able to review the application for adequacy until TR57 is approved (Ron suggested that the changes I
not be included, so it should be relatively easy to complete)
• Arcadis are still finalising their report from last summer's vegetation sampling
• Ron is also going to ask Arcadis about the SedCad results for the ponds at Lorencito (ponds 9A and 7 are of particular interest)
• Work on the abatement of NOV CV 2013 -009 was encouraging. Vince and John said that they would not be able to achieve the trapezoidal section for the ditch though, so a revision v
ditch with a triangular section. The abatement deadline is 1/24, so you will certainly need to request an extension for that to allow time for the revision
• Pond 7 at New Elk has not yet been discharged and approval has not yet been given by CDPHE for the use of a flocculant. Ron intends to sample it when the ice melts to see if it car
water
• Chemicals which had been stored next to pond 7 had been moved to the old explosives storage area. I understand the reasons for the move (larger berm, enhanced likelihood of spills
river). I need to make sure that there are no other issues.
• I am waiting on your response to my initial adequacy review of TR68. I failed to review the proposed section 3 (entirely my mistake). We had decided that we would wait and review it v
letter, but I think that was the wrong decision, particularly as it has such significant implications for the amount of bond required. Instead I have requested some assistance to review tl
ASAP.
• Kent will still be working on TR68 and it is OK for me to communicate with him directly
I think that was everything we talked about...
I meant to say that I was sorry to learn that Bobby had been laid off, I hope you pass on my regards if you see him.
Leigh
Leigh Simmons
Environmental Protection Specialist
Colorado Division of Reclaration, Mining and Safety
1313 Sherman Street, Room 215
https: / /mail.g oog le.conVmai I /u /0 / ?ui =2 &i Ire29129fcb5 &viev-- pt &search =i nboy&th= 143bae5fc842450c 1/4
