Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your <br />responsibility to request an extension of the review period. If there are outstanding issues <br />that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny this application. <br />1. The Applicant stated in the response to Adequacy Review No.l that the site will be reclaimed <br />to a post- mining land use of Industrial /Commercial. The Application Form and attending <br />materials submitted with Amendment No. 1 stated that the post- mining land use would be <br />wildlife habitat. In addition, the newspaper publication and the notice to the surrounding <br />landowners stated the post- mining land use would be wildlife habitat. <br />Pursuant to Rule 1.6.6, if a notice is in error or a change to the application is so substantial <br />that it affects any of the terms contained in the notice that was published in the newspaper or <br />mailed to the owners of affected and adjacent lands, then the Applicant shall be required to <br />publish and mail new notice of the application. Please publish a new notice in the newspaper <br />which reflects the change of the post- mining land use. Also, provide a copy of the new notice <br />to the adjacent landowners. All applicable deadlines shall begin to run anew and the <br />Applicant must provide copies of the revised notices to the Division before a final decision is <br />issued. <br />2. The Applicant has specified that stormwater BMP's will be installed following reclamation. <br />The Applicant should note that the BMP's must be removed before final release of <br />reclamation responsibility. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
